Imagine yourself in this nightmare. You stand charged with the offense of capital murder, a crime you did not commit.
The State has waived the death penalty, which is cold comfort when you consider that if found guilty, you will automatically receive a life sentence.
You are 35 years old, and under Texas law, you will have to serve at least 40 calendar years before you would first become eligible for parole. If convicted, your best case scenario is that you would be 75 years old before you could be released from prison.
The stakes could hardly be higher. There’s a good chance you could live the rest of your life in misery and then die in prison.
If you don’t feel compelled to offer to plead guilty to a murder you didn’t commit for at least a 5 year sentence, you might want to think again. Would you rather leave prison when you’re 40, or when you’re 75?
